Notes:

1. I definitely dispute the idea that during the phone call I was informed of my so called misdemeanour and that it was discussed in any substantial way
2. If as Neil asserts, I’ve revealed privileged information my only recollection of any correspondence is that with the Mayor & GM, both members of the MBAG not present at the meeting where this information was noted but not discussed. Furthermore that correspondence was confidential and any disclosure to Neil could be seen as a breech of confidentiality.
3. I do dispute that a phone call making and allegation would represent disclosure of evidence in any event and neither would a private confidential conversation as Neil was proposing
4. Arguably if Neil chose to act as indicated above he was intending to bully me without a witness present and at two previous meetings he ’counselled’ me to conform in a patronising way .... I had lost any appetite for being treated in this unacceptable and inappropriate way even if he was the Chairman of the MGAB

Your email below refers.   I intend to deal with the matters to which you refer in discussion of the Motion at the Special General Meeting.  I do not intend to engage in a lengthy email dialogue in the interim, other than to clarify a few points for you.

1.       I set in motion calling of a Special General Meeting and submitted the Notice of Motion, not Richard Mulvaney.

2.       You were made aware of the specifics of the quoted privileged information in my most recent telephone call to you on the morning of 25th June, namely the MMCLink Report and the Council submission to government and oppositions prior to the State Election.

3.       I called you as soon as I was aware of the disclosures.

4.       Any disclosure, even if only to existing Council staff and Aldermen, is contrary to everything discussed and agreed at the most recent MGAB meeting as the basis of a Board Communications Protocol that would reflect good Board and governance procedures.

Dear Mr McKinnon,

In relation to Mr Mulvaney's Board Motion and Notice of 1 July 2014, no evidence whatsover is presented to support the allegations made against me and reportedly made by you.

As it stands, it appears that you are effectively defaming me (in writing)  on the basis of allegations claimed by you to have been made to you by the General Manager.

The defamation of my good name to the members of the Board has been carried out by Mr Mulvaney and distributed to various people (e.g. the MGAB) without being marked as confidential by the QVMAG’s Director Mr Mulvaney who has sent out the notice.

In brief, I have been accused it appears, by a General Manager (apparently according to you), of 'quoting privileged information' and therefore of being untrustworthy as an MGAB board member. No evidence of any type has been supplied to me to support this damaging allegation. For my part, I am confident that any 'privileged information' has only been circulated by me to existing Council staff or Aldermen, and marked 'confidential' when appropriate.

The time to raise such a concern would have been at the time it occurred so that I could could adjust my behaviour accordingly. No such interaction occurred, neither has any evidence been presented to support the supposed 'quoting'.

In effect, your response as the MGAB chairman to various critical questions about board policy and practices, museum governance and management has been to defame me, in writing, and to circulate defamatory concerns about me in an open letter that is not marked 'confidential' in any way (although that flaw may have been created by Mr Mulvaney).  Whether the General manager of Council participated in, or precipitated these defamatory statements is not known as all materials and charges have been made through Mr Mulvaney and apparently by yourself.

Such defamation is illegal in Australia and can carry onerous penalties.

I therefore request that you and Mr Mulvaney either:

1) Retract in writing the unsupported allegations and defamations against me and copy that retraction to all who have received a copy of Mr Mulvaney's defamatory correspondence on behalf of yourself or who may have been exposed to these claims

OR

2) Present incontrovertible evidence of the charges being made against me for my consideration and action

I look forward to your early action on this matter.
